Manifestation Determination Review (MDR): Legal Mandates and Guidelines for Application



Determining whether a behavior is actually a manifestation of the student’s disability can be a very difficult endeavor!  Attend this workshop to learn how to make legally compliant manifestation decisions in a systematic and data-based method. 

We will begin with an overview of Federal and State legal mandates regarding MDRs.  Myths and truths of MDR will be reviewed that will support efficient, effective and legally defensible practices. 

The second part of the training will propose a framework for how to collect data and make data-based manifestation decisions.  Case studies will be used to practice application of the process.  In addition, MDR due process hearing decisions will be discussed with emphasis on trends and pitfalls.  Useful documents will be provided to support implementation.

Learner Objectives:

  1. Learn how to make legally compliant manifestation decisions in a systematic and data-based method.
  2. Learn the multiple types of information to collect in order to conduct a data-based manifestation determination.
  3. Learn the steps to follow when, in an MDR ARD, it becomes obvious that the committee has insufficient data to make a manifestation decision.
  4. Utilize legal case studies to understand the trends and pitfalls of the manifestation determination process.
